The 6 Month Rule

Recently I posted the following on the Small Business forum FLyingSOLO.com.au.

As usual , Assertions, BS, and just plain "Make it up as I go along" seems to be the basis for most people's objections to the removal of this regulation

(NO FS Members It was NEVER A LAW and auDA has no power to set PRICES for domains or C.O.R. transfers)

Facts/

  1. There was 2 Regulations covering the resale.
    • The 6 month rule.
    • The one prohibiting Purchase based solely on the plan to resell at a later date.
  2. The purchase and later resale of domains (or more correctly the license to use the name) is as legal and as valid as selling a CAB license or selling a Radio Spectrum License. Both of these have been subject to squatting as well as legal trading. There is a big difference between Buying names and reselling them for a profit if that is your business model or Holding a large portfolio to hold business purely for ransom to get them form you is not.
  3. Domaining Professionals are normal SMALL Business men and women doing what I thought this Forum was all about. Small businesses buy a product maybe at a very cheap price, maybe add some value to it by promoting it or enhancing it. They then sell at a FAIR PRICE to interested RETAIL customers. No different to IGA buying Baked Beans for 30c a CAN in BULK, advertising it on TV and then reselling to their franchised Supermarkets for 45c a can. The local IGA then advertises the Can of Baked Beans for 99c and a Retail customer happy to find a reasonable priced can of Beans buys it at the checkout. It would be a different business model if the BakedBeanSquatter bought up every can of beans and waited until someone wanted a can and said $50 please. No domainer (private) or Domaining Business (LIKE OMG - a Fairfax company) would or could buy every name available.
  4. Domain or Cybersquatting regulations are still in place as are Rules coverng the ownership of TM'ed, or Registered Company Business Names. This includes misleading,Mis-spelt and Sound alike Names like googel.com.au
